A 46-year-old Wallace man will spend two to seven years in prison after being convicted of Operating While Intoxicated, with a blood-alcohol content more than twice the legal limit.

David Howard Lemery was sentenced Friday, Aug. 7, in the 41st Circuit Court in Menominee County, according to a press release from the Menominee County Prosecuting Attorney's office reported by WLUC.

The case stems from a Dec. 27, 2025, traffic stop. Officers from the Menominee Police Department saw a vehicle traveling northbound on First Street near Tenth Avenue in Menominee. They identified Lemery as the driver.

Lemery admitted to officers that he did not have a valid operator's license and that he had been drinking before getting behind the wheel. He conceded he was impaired. Officers found a THC vape device in his pocket.

A blood test showed Lemery's BAC at .181, well above Michigan's .08 legal limit and exceeding the .17 threshold that triggers the state's "Super Drunk" enhancement. The test also confirmed the presence of THC.

The Menominee County Prosecuting Attorney's office did not specify the charge classification or Lemery's prior record in its announcement. The office, led by Prosecuting Attorney Jeffrey T. Rogg, announced the sentencing Monday, Aug. 10. No statement from a defense attorney was included in the release.

Wallace is a small, unincorporated community in Menominee County in the southern part of Michigan's Upper Peninsula, situated near US-41.
